Terms of Service

Welcome to GradeUS.ai. These Terms of Service ("Terms") govern your access to and use of the GradeUS platform, including all associated services, features, and applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using GradeUS.ai, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an educational institution, you represent that you have authority to bind that institution to these Terms.

2. Description of Service

GradeUS.ai is an AI-powered academic grading and learning management platform that provides:

  • Automated and AI-assisted grading of student submissions
  • Course management tools for professors and instructors
  • Student performance analytics and feedback generation
  • Document processing and OCR capabilities for exam materials
  • Communication tools including messaging and discussion forums
  • Meeting scheduling and coordination features
  • AI-powered chat assistance for academic queries

3. User Accounts and Registration

3.1 Account Creation: Access to GradeUS.ai is by invitation only. Professors are onboarded by platform administrators, and students receive invitation links from their professors. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security: You agree to immediately notify GradeUS.ai of any unauthorized use of your account or any other breach of security. You are solely responsible for all activities that occur under your account.

3.3 Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information as necessary.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload, transmit, or distribute any content that is harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Attempt to gain unauthorized access to any part of the Service, other users' accounts, or connected systems.
  • Use the Service to engage in academic dishonesty, including but not limited to plagiarism, unauthorized collaboration, or manipulation of grading outcomes.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Use automated means (bots, scrapers, crawlers) to access or interact with the Service without our express written permission.
  • Share, distribute, or reproduce course materials, examinations, or grading rubrics without authorization from the content creator.

5. AI-Powered Grading Disclaimer

5.1 Nature of AI Grading: GradeUS.ai utilizes artificial intelligence models to assist in the grading and evaluation of student submissions. AI-generated grades, feedback, and analyses are provided as tools to assist educators and are not a substitute for professional academic judgment.

5.2 Accuracy: While we strive for accuracy in all AI-generated outputs, we do not guarantee that AI-generated grades or feedback will be error-free. Professors retain ultimate responsibility for reviewing and finalizing all grades.

5.3 Anomaly Detection: The platform includes anomaly detection features designed to flag potential irregularities in student submissions. These flags are advisory in nature and do not constitute accusations of academic misconduct.

6. Intellectual Property

6.1 Platform IP: The GradeUS platform, including its design, features, algorithms, source code, and documentation, is owned by GradeUS.ai and protected by intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the platform except the limited right to use it in accordance with these Terms.

6.2 User Content: You retain ownership of content you upload to the platform (e.g., course materials, examinations, student submissions). By uploading content, you grant GradeUS.ai a non-exclusive, worldwide, royalty-free license to process, store, and analyze such content solely for the purpose of providing the Service.

6.3 Feedback: Any suggestions, feedback, or ideas you provide regarding the Service may be used by GradeUS.ai without obligation to you.

7. Data Retention and Deletion

We retain your data for the duration of your account and for a reasonable period thereafter as required by law or legitimate business purposes. You may request deletion of your account and associated data by contacting us at support@gradeus.ai. Upon account deletion, we will remove your personal data within 30 days, except where retention is required by law.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GRADEUS.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGE TO ACADEMIC STANDING, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO GRADEUS.AI IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless GradeUS.ai, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

10.1 By GradeUS.ai: We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, academic dishonesty, or inactivity.

10.2 By You: You may terminate your account at any time by contacting support@gradeus.ai. Termination does not relieve you of obligations incurred prior to termination.

10.3 Effect of Termination: Upon termination, your right to access the Service immediately ceases. Sections relating to intellectual property, limitation of liability, indemnification, and governing law shall survive termination.

11. Modifications to Terms

GradeUS.ai reserves the right to modify these Terms at any time. We will notify you of material changes via email or through the platform. Your continued use of the Service after such notification constitutes acceptance of the modified Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles. Any legal proceedings arising under these Terms shall be brought exclusively in the courts located in Delaware.
